Protecting PowerMediaPlus Content Under

Copyright and Fair Use

 

The original intent of all PowerMediaPlus.com video and audio content must be maintained, with the exception of titles that have been identified as “editable content,” users may not shorten a clip or include it in a podcast. Users may edit or alter only those PowerMediaPlus.com clips that are identified as “editable.” Users may keep projects utilizing video and audio clips from PowerMediaPlus.com for use in their personal portfolios, provided their school or institution’s subscription is active. If the user’s school or institution does not renew its subscription to PowerMediaPlus.com, that user is personally responsible for removing all electronically stored clips.Converting digital video to analog (taking a video clip from the computer, a CD, or other media and recording it onto a VHS tape) is in violation of copyright law.

 

The distribution of PowerMediaPlus.com podcast RSS feeds is limited to PowerMediaPlus.com subscribers only. Only PowerMediaPlus.com users may subscribe to podcasts containing PowerMediaPlus.com content. Publishing a podcast or any other multimedia file containing PowerMediaPlus.com content outside of the PowerMediaPlus.com system (on iTunes or any other media hosting Web site) is in violation of copyright law.

 

When uploading lessons or projects that integrate PowerMediaPlus.com content to an institution’s server or when locally hosting any PowerMediaPlus.com content, the content must be protected behind a control system or firewall.

Subscribers may utilize distance learning tools with PowerMediaPlus.com subscribers only. Provided that all users and end-users are PowerMediaPlus.com subscribers, users may create a virtual classroom or multicast that displays content across closed-circuit television.

 

Educators and their students may use PowerMediaPlus.com from home to access content as long as the user is utilizing a unique, secure password and the institution’s subscription is active.

 

Users must cite all borrowed content. (See below for citation information.) When modifying ancillary materials, include the following statement: “Revised with permission from CLEARVUE & SVE. However, CLEARVUE & SVE is not responsible for the content of the revision.”

Content on PowerMediaPlus.com is strictly for use by accredited educational institutions, their employees, and students within the course of instruction. Content may not be resold, used in projects for sale or rent, or used in activities where a fee is paid to view the content. According to our Terms of Use, in addition to federal copyright law, users are required to

 delete or destroy all copies of any video, image, audio, or print file or other content from all media (servers, hard drives, storage devices, computers, CDs, tape backups, etc.) upon subscription conclusion. Users may be sent a Certificate of Erasure to sign and return to CLEARVUE & SVE as proof of compliance.

 

In accordance with the signed license agreement, accessing any content from PowerMediaPlus.com indicates all users’ acceptance of the Terms of Use and legally binds users to these Terms.
